I could see "worst" as in least effective. Still better than Earl Warren, who was quite effective at dismantling the Constitution. Good thing we got on W's butt until he nominated a real judge (Alito). Could you imagine Harriet Miers on the court?

I think that O'Connor was the worst Justice ever because she was totally dominated by feelings. You never had a clue how she was going to come down on a case. O'Connor is the type of Judge who decides how she wants to rule and then bends and massages the law to fit her result, which usually produced a laughable reasoning, which was difficult for most rational law professors to justify. I respect Ginsburg as much as I respect Scalia because you know exactly how they will rule on an issue and they are steadfast on their interpretation of the law. I think that O'Connor decided cases by picking the petals off of a flower. The Plaintiff wins, the Plaintiff wins not....

I understand the sentiment, but worst justice EVER? I mean, worse than Earl Warren? Worse than David Souter or Ginsburg? I would think that since her reasoning was so wishy washy and specific to the case and time (i.e. in 25 years we won't need affirmative action) that there would not a strong basis for precedent for future rulings. In other words, no ruling could generalize to other rulings. It seems to me the damage is limited and can be undone. Warren, on the other hand...well, you're the expert on this so make your case.
